Cowboys and Angels Terms and Conditions
Introduction
It is essential for both us Cowboys and Angels and you
(the person hiring the bus) to understand what is expected
from each other. For the purpose of this document the following
interpretations apply:
HIRER
This is the person who hires the bus. The Hirer is the person
named on the booking form.
SELLER
Us, Cowboys and Angels agree to sell the services to the Hirer
subject to all the Terms and Conditions.
ONLINE BOOKING FORM
Is the document that is filled in by you – the Hirer in order
to make a booking with Cowboys and Angels.
TERMS AND CONDITIONS
Terms and Conditions are the terms under which the Seller
agrees to do business with the Hirer.
VEHICLE
Means: Any of the vehicles Cowboys and Angels have to offer /
hire.
STAFF
Means: The driver or party host employed by Cowboys and Angels.
TERMS AND CONDITIONS
1.1 Cowboys and Angels will supply a service to the Hirer and the
Hirer will pay for the services in accordance with the terms and
conditions. The Hirer accepts the terms and conditions.
1.2 Any variations in the terms and conditions can only be
permitted if confirmed in writing by Cowboys and Angels.
The Hirer agrees to inform all members of the group that the
event is booked and of all the terms and conditions and
agrees to ensure the conditions are adhered to.
1.3 A booking is made and a contract formed when Cowboys and
Angels receives a booking form from the Hirer along with a
£50 deposit and we confirm that booking to the Hirer.
The deposits are non-refundable.
1.4 Deposits can be made by postal order, cash, or credit/debit
card. If paying by Credit/Debit card you will be charged an
additional £3.00 handling fee.
1.5 When requesting a booking on-line, forms must be filled in
correctly and supplied to us within a reasonable time before
the booking date.
1.6 Once Cowboys and Angels has received the booking form from
you, we will confirm your booking by telephone and if requested
by you the hirer we will send by email an invoice for the balance
payment,
1.7 You, the Hirer, agree to indemnify the Seller in full against
all loss, cost, damages, charges and expenses incurred by
Cowboys and Angels as a result of a cancellation by you.
OPERATIONS
2.1 The vehicle will normally arrive at the address given
on the booking form at the time confirmed. If there is no
room to allow the vehicle to be at the address, you should
arrange another suitable venue in advance, should gain permission
and pay any fee that is due for the vehicle to park in this venue.
2.2 If on arrival the driver of Cowboys and Angels judges the
parking to be unsuitable or inadequate their decision is final.
2.3 Cowboys and Angels will not take responsibility for any
delay in reaching any venue. We will endeavor to arrive on time
were circumstances permit. If time allows we will try and stay
for the time paid for, but will not otherwise be responsible for
any loss, costs, charges or expenses incurred by the Hirer as a
result of late arrivals. When the bus is booked for a party, it
is for a period of 1 hour 20 minutes for adult parties and 1hr
for children's parties unless otherwise agreed in writing.
HIRER
3.1 The Hirer will be responsible for any damage caused to the
vehicle by any member\guest of the Hirer's Group.
3.2 The Hirer will also be responsible for any damage caused
to the interior or exterior of the vehicle as a result of
incitement.
3.3 The Hirer has to ensure that groups\children\guests do not
behave in such a way that puts safety to others at risk, or damage
the bus.
3.4 The Hirer will be responsible at all times for the welfare
of all persons attending the party whether inside or outside of
our vehicles.
3.5 You may not eat or drink in any of our vehicles unless
there is a vehicle such as the party bus designated to do this.
Under no circumstances may there be any smoking on ANY of our
vehicles.
3.6 The Hirer must provide two responsible adults to supervise
any children and monitor the exit door at all times.
3.7 No Animals are allowed on the vehicles at any time.
3.8 The Hirer is responsible to ensure that everyone in their
party wears suitable clothing. While every effort is made in the
drivers part to to ensure a smooth drive we can not be held
responsible for damage to clothing caused by liquid spills due to
movement of the bus.
3.9 The Hirer is responsible to ensure that everyone in their
party is not intending to or has not brought glass drinking utensils on board the vehicle.
3.10 The Hirer must leave the bus in a clean and tidy condition
to the satisfaction of the driver.
3.11 The Hirer must look after the equipment and ensure that
nothing is removed from the vehicles at any time.
3.12 The Hirer must make themselves known to the driver on
the day of booking.
3.13 The Hirer must ensure and is responsible for ensuring
that all inappropriate footwear is removed when entering the
vehicles.
3.14 The Hirer must ensure there is adult supervision at
all times.
3.15 The Hirer is responsible to ensure that everyone in
their party is aware of terms and conditions of hirer and that
a copy of the terms and conditions can be found on our web
site and also on our buses.
3.16 The hirer is responsible to insure everyone in their
party is aware that during the duration of their party Cowboys
and Angels staff will take images of the evening and these
images will be placed on the Cowboys and Angels gallery website
for purchase by anyone who wishes to do so.
3.17 It is the hirers responsibility to inform the driver
when boarding the bus if anyone in their party does not consent
to having their image taken and put on the Cowboys and Angels
gallery site. In such circumstances the hirer must put this in
writing before signing the terms and conditions. The hirer is
responsible for informing all members of their party about
images and procedures. Cowboys and Angels will be indemnified
against any complaints/claims by the hirer and all members of
that party were they have not followed proper procedure as
stated above.
SELLER
4.1 Safety is our paramount concern, therefore if any of
our staff see members of your group\guests\children jeopardizing
our safety policy they will be entitled to remove them from the
bus and no refund will be due.
4.2 Cowboys and Angels does not accept responsibility for any
loss, damage,inconvenience, injury or death arising from any
accident, breakdown or delay attributable to reasons beyond our
control and it is the responsibility of the Hirer to arrange
appropriate insurance for the group/children/guests.
4.3 Anyone behaving in a careless or irresponsible manner
which might cause an accident will be suspended.
4.4 Cowboys and Angels cannot be held responsible for any
personal valuables on- board our vehicles.
4.5 Cowboys and Angels asks that no members enter the bus
until requested to do so.
4.6 In the unlikely event that we experience a mechanical
break down during the time of your booking, Cowboys and Angels
will make ever effort to find alternative transport of their
choice from the break down site to the location pre-booked by
the hirers.
4.7 Cowboys and Angels will not be responsible for arranging
alternative transport if the hirer has not paid in full for
the vehicle they are traveling in.
COMPLAINTS
5.1 All complaints are taken very seriously but must be put
in writing to Cowboys and Angels and should be addressed to
Cowboys and Angels, PO Box 49, Ballyclare, BT39 1AW.
MISCELLANEOUS
6.1 The Seller will not be liable (other than liability for death
or personal injury resulting from the Seller's negligence)
for loss, injury or damage caused by third parties provided
by the Seller where such loss, injury or damage arises from
the act or omission of the third party.
6.2 The Seller's liability to the Hirer (other than liability for
death or personal injury resulting from the Seller's negligence)
for any loss or damage of any nature:
(a) arising from any breach of the terms and conditions or
(b) any negligence, breach of statutory or other duty on the
part of the Seller or
(c) in any other way out of or in connection with the
non-performance of or purported non-performance of, or failure
to perform the services in accordance with the terms and
conditions is limited to the cost of the booking. The Seller
may in its discretion suspend or terminate the supply of any
Services if the Buyer fails to make payment when the same is
due, or defaults in any of its obligations under the contract
with the Seller, or the Seller bona fide believes that any of
the aforesaid events may occur.
6.3 The Hirer is not permitted to cancel this agreement except
with the written consent of the Seller. Cancellation terms
are as follows:
28 days before the party - full refund less deposit, however
Cowboys and Angels will allow the Hirer a credit of 50% of
their original deposit towards re-booking the party bus
within 3 months of the original party date subject to availability.
6.4 The Contract is between the Seller and the Hirer as principals
and may not be assigned by the Hirer without the
express written consent of the Seller.
6.5 These Conditions form the whole agreement between the Seller
and the Hirer and shall not be removed or varied in any way.
6.6 If the Seller is in default of any of its obligations hereunder,
it shall not be liable where such default is due to any act of
God, war, strike, civil unrest, lockout, industrial action, fire,
drought, tempest or other event beyond the reasonable control of
the Seller. In such circumstances, the seller shall give notice
to the Hirer where possible and be released from performance of
its obligations hereunder to the extent supervening impossibility
prevents or restricts the Sellers performance.
6.7 These Conditions are subject to British Law and the Buyer
consents to the exclusive jurisdiction of the Northern Ireland
courts in all matters regarding the Services.
6.8 It is not the intention of the parties to confer any rights
contained in The Contracts (Rights of Third Parties) Act 1999
or any third parties referred to herein and any such rights
which may otherwise be implied are hereby excluded.
6.9 By Booking any of our services you, by default agree to all
of our policies, these can be changed at anytime.
PRIVACY POLICY
We believe strongly in protecting our customers' privacy
so when we collect personal information from you when you use
our website to purchase goods or enter a website promotion or
competition we will use our best endeavours only to use it or
disclose it in the manner stated below. By using our website
services, you agree that we may do so.
7.1 Communicating with you: Each time you use our service,
we will send you a confirmation email verifying the order.
We also reserve the right to send all customers of our service
email communications from time to time regarding updates and
changes to our goods and services, new links to our website
and any technical, administrative or legal notices important to
our website, our products and services that we consider essential.
7.2 Information shared: We are the sole owners of the
information collected on this website. We will not sell, rent
or otherwise disclose your personal information to any third
party, without your consent except in the following
circumstances:
. We do share non-personal, non-individual information in
aggregate form with third parties for business purposes, for
example with advertisers on our website or we may tell our
business partners the number of customers in certain demographic
groups who purchased certain products. This does not involve
disclosing any personal information which can identify any
individual customer in any way.
7.3 Our records: Once payment has been processed all
information is disposed off and no financial details are kept
after payment.
7.4 We will disclose your personal information to any
appropriate investigative third party if we believe that you
are involved in any illegal or harmful conduct or if we are
required to do so by law or we believe that such action is
necessary to
(1) comply with the law or with legal process;
(2) protect and defend our rights and property or that of
our customers;
(3) prevent fraud;
(4) protect against abuse, misuse or unauthorized use of
our website; or
(5) protect the personal safety or property of our customers
or the public (eg. if you provide false or deceptive information
about yourself or attempt to pose as someone else, we will
disclose such information about you as we have to assist any
type of investigation into your actions).
7.5 We may employ other companies to provide services for us,
including for example, delivery of orders or processing of credit
card payments. These companies have access to the personal
information needed to perform their functions and not for any
other purposes. They are bound by confidentiality agreements
not to disclose any information for any other purpose.
7.6 We may transfer our customer database, including personal
information contained therein, to a third party who acquires
all or substantially all of the assets or stock in our company
or our website service whether by merger, acquisition,
reorganization or otherwise.
7.7 Links - Our website may contain links to other websites.
Please note that we are not responsible for the privacy
practices of such other websites and advise you to read the
privacy statements of each website you visit which collects
personal information.
7.8 Cookies - A cookie is an alphanumeric identifier which we
transfer to your hard drive through your web browser when you
visit our website. It enables our own system to recognise you
when you visit our website again and improve our service to you.
Cookies may also be used to compile aggregate information about
areas of our website that are visited most frequently. This
traffic information can be used to enhance the content of our
website and make your use of it easier. We do not track which
pages you looked at while visiting our website. If you wish to
reject our cookie, you can configure your browser to do so.
The Data Protection Act 1998
8.1 The information that you give us, including your e-mail
address, is termed "personal data" under the Data Protection
Act 1998. We must therefore follow the principles set out in
that Act when we process your personal data. All the personal
data that we obtain from you is held on our central in-house
database. Cowboys and Angels is a "data controller" for the
purposes of the Data Protection Act 1998.
8.2 Please note that clicking on to links on our website may
result in you transferring to another website, where data privacy
practices may be different to that of Cowboys and Angels.
Visitors should review the other websites' privacy policies, as
we have no control over what happens to information that is
submitted to or collected by third parties.
Security
9.1 Security cameras are on board all our buses and are used for your
safety and to deter vandalism on our vehicles. |
